Charisma Carpenter of TV's Buffy the Vampire Slayer and Angel has split from her husband of four years, Damian Hardy, PEOPLE has learned.

"They are separated and now living separately," Carpenter's rep Jeff Raymond confirmed Tuesday.

Carpenter, 37, and Hardy married on Oct. 5, 2002, and became parents to son Donavan Charles the following March.

Carpenter will next be seen as Christopher Titus' wife in ABC's Big Shots on Dec. 13.

It's always a shame if a marriage fails, but when there's a child involved it's even worse. I do hope they can part on friendly terms, maybe then the divorce won't have too bad an effect on Donovan.

Hello everyone-

I know you all have several questions about Damien and I but some are personal and some I don’t have the answers to. All I will tell you is that we are NOT divorced and Donovan is fine and hanging in there. We are having problems and we are getting through them one step at a time. Thank-you all so much for your kind words and support. I love you all so much !

Let’s move away from the water works and talk about the holidays ! Any special plans ? My family and I are going to San Francisco to celebrate and spend time with family and friends. I am very excited to see my brothers ! My brother is going to be very excited to see everyone as well because he hasn’t seen too many family members in a while. For New Years Eve, friends are coming over, we are going to have a small get together and go out to celebrate the New Year. I am ready for 2008. I have some guest appearances and magazine shoots already scheduled for the 2008 and of course my new television show ! It’s going to be enjoyable and great to watch. I got an idea from an article in a magazine and it’s NOT going to be a reality show ! I will most definitely release more information in January 2008.

I really hope you guys love the website. We are still in the process of updating and adding more things but it looks really good from my point of view. Let me know what you guys think about it ! I now have a contact form on my page on the website so when you guys want to say hi, have a question for me personally or whatever just hit me up there ! The contact form on the contact page is for questions about the website and etc…

Another thing is the store is going to open in January 2008. We wanted to open it in November, that didn’t happen and then December but we wouldn’t be able to get the items to you in time :( We already have a long list of items that’s going to be in the store but if you have any ideas on something else, hit me up !

It's not just Hollywood.
Statistically speaking you're 50% likely to end up in divorce no matter where you live and what you do.

If they are divorced, or breaking up, or whatever, I mostly feel sorry for their son, he's what 4 or 5? My friends parents split up when she was four, and it really made a difference to the way she turned out. It's gotta be hard. But I hope they can manage to work things out.

Thats actually difficult to say.

You are making an assumption that this friend of yours was going to be one person and from the way you write your friend isn't as 'good' as she could have been had she had two parents together.

Sometimes a divorce is in the best interests of the whole family, sometimes staying together can be destructive even if the 'parents' get on.

There are many differing factors that makes a child grow up to the adult they become and although the divorce will be part of it, it doesn't necessarily send them down a bad road.

If both parents love the child and show their love with as much contact as possible, the child will not suffer in that respect.

There is also an argument that we are all destined to be who we eventually are and if that is the case, doesn't matter what kind of upbringing one has.

Its the old Nature vs Nurture argument.

I guess that's true. Just generally she never sees her Dad, and it makes her pretty depressed, is what I mean. Hopefully, Damian [That's his name, right? Even if I spelt it wrong...] Well get to see his Dad, then it shouldn't be so bad in the long run =]

Hollywood doesn't set you up for divorce, being human does. ;)
And I too don't think that being divorced 'hurts' a child in anyway. It depends on how that children's parent or parents raise them, period. I had two parents, my spouse had one, we were both raised in a loving home and turned out great.
Still sad for Charisma, getting back to the topic. Hope whatever it is everyone comes out happy.

According to Charisma Carpenter, the writers' strike is slaying her earning capacity.( found this on eonline)

The former Buffy the Vampire Slayer and Angel star claims that the ongoing Writers Guild of America walkout has left her unemployed, and therefore without the means to afford the attorneys' fees pertaining to her current divorce proceedings, according to court documents filed Dec. 4.

In turn, Carpenter has requested that estranged hubby Damian Hardy be required to pay her legal bills.

Per her declaration, the last work the 37-year-old actress had was a Nov. 26 appearance on a TV show that has not yet been renewed or picked up. The nearly seven-week-long strike could go on for months and, even if it ends, the Screen Actors Guild contract is up for renewal in June and could prompt further labor action, she said.

Carpenter briefly guest-starred on Fox's Back to You as the single mother of a bully who has been terrorizing the daughter of the bickering news anchors played by Patricia Heaton and Kelsey Grammar. Grammar's character, Chuck, wants to give the kid's mom a piece of his mind—until he sees how hot she is, of course.

The sitcom's status is still up in the air, along with the fate of myriad other freshman series, thanks to the strike.

"At the present time, [Hardy] has the ability to work full time and make more money than I am currently making," Carpenter states. "[He] should be paying my attorneys' fees and costs…The court should uphold the spousal support waiver, but if it does not do so, it should award spousal support to me."

The 2004 Playboy cover girl says that her and Hardy's prenup includes a waiver of spousal support by both sides in the event that their marriage fails to last seven years. Carpenter filed for divorce Aug. 2.

But Hardy, who stated in a declaration filed Nov. 27 that he quit working for awhile to be a stay-at-home dad for their four-year-old son, Donovan Charles Hardy, maintains that he wasn't fully aware of what he was getting into before he agreed to the premarital arrangement.

"I do not recall any discussion regarding the waiver of spousal support, and no one explained to me what rights I was giving up regarding spousal support by signing the premarital agreement," Hardy stated.

He claims that before the couple swapped vows in October 2002 he earned $18,000 a year working as a hotel bellman and supervisor. Meanwhile, Hardy stated, Carpenter is capable of making up to $500,000 a year (what he says she earned in 2004) as an actress.

"I have recently returned to work, but I am making less than $2,000 per month and I cannot afford to go to school at this time," Hardy, a high school graduate, said.

A hearing on custody and financial issues is scheduled for Jan. 9.

I didn't even realise she was married!! How much have I not been paying attention!!

I hope everything works out for her though!
